Senate sues Apatang, Macaranas, seeks TRO

The Senate filed a lawsuit against Gov. David M. Apatang and Anthony I. Macaranas, asking the Superior Court to immediately block Macaranas from exercising the powers of Department of Public Safety commissioner.

Macaranas was first removed as CNMI police chief last Feb. 23 by then-acting governor Dennis C. Mendiola, but Apatang reinstated him last March 5.

In its Sept. 18 filing, the Senate argues that reinstatement was never submitted for Senate advice and consent within the required 30 days, automatically disqualifying Macaranas from the position.

The lawsuit also challenges Apatang’s Sept. 14 rescission of acting governor Karl R. King-Nabors’ Sept. 11 removal of Macaranas and withdrawal of Aniceto T. Ogumoro’s nomination.

The Senate is seeking a temporary restraining order and an expedited hearing on a preliminary injunction.
