Approved by the Commission on August 6, 2026, the changes replace outdated regulations with a modern, transparent framework designed to safeguard employees during periods of economic uncertainty.

Key Elements of the Proposed Furlough Framework

The proposed amendment to Section 10-20.2-267 replaces undefined procedures with strict institutional safeguards

• Mandatory 90-Day Process Window: All steps-from the Governor's official declaration of a fiscal emergency to the final implementation-must fit within a strict 90-calendar-day timeline.

• Documented Prerequisites: Furloughs cannot be initiated until specific financial austerity conditions are verified and documented in writing by OPM.

• Critical Position Screening: Exempts essential, federally funded, and obligated positions prior to establishing any agency furlough rosters.

• Independent OPM Oversight: Requires the Director of Personnel to review assessments and concur in writing before any individual employee notice can be issued.

• Guaranteed Employee Notice & Due Process: Secures a non-waivable 15-calendar-day advance notice, a 7-day period for written employee response, and a 15-day grievance window.

• Guaranteed Recall Rights: Mandates that employees be recalled to duty in order of retention standing as funds or work become available within the 12-month window.
